I don’t recall any provision of the Constitution that allows the founding document to be suspended during a “state of emergency” Congress may have passed an unconstitutional law or there may be an unconstitutional executive order on the books though. If the Constitution is suspended then the authority of the Federal Government evaporates and the State assumes governance of their respective lands and peoples.
Any intrusion by the delegitimized Federal Government would be an act of agression upon the states. The states woulld have the right to defend themselves.
That’s how I see it.
